The Company is a recruitment agency which provides headhunting services to its clients and help securing employment to candidates. The Company must process personal data (including sensitive personal data) so that it can provide these services and in doing so, the Company acts as a data controller.
Fleetwood Saunders is committed to meeting all Data Protection obligations and ensuring the protection and security of all personal information, complying with both the Data Protection Act (DPA) and the General Data Protection Regulation (GDPR).
You may give your personal details to the Company directly, such as on an application or registration form or via our website, or we may collect them from another source such as websites, a jobs board or LinkedIn.
1. Collection, use and retention of personal data – Candidates
1.1 Purpose of collection and processing - Candidates
When you contact us, we contact you or you apply for an advertised job opportunity, the Company will collect your personal data (which may include sensitive personal data) and will process your personal data for the purposes of providing you with work-finding services. This data consists of information such as your name, address, e-mail address, telephone number, career history and education plus, where relevant, your nationality and basis for working in the UK as required by law. We will hold and use this information for the purposes of finding you job opportunities.
1.2 Legal Basis - Candidates
The Company must have a legal basis for processing your personal data. For the purposes of providing you with work-finding services and/or information relating to roles relevant to you we will only use your personal data in accordance with the terms of the following statement:

When you register with us we will ask you to complete a Registration Form which includes our Privacy Policy and asks for GDPR consent. If you have completed this and given consent for us to use your personal data the legal basis of “consent” will apply.
1.3. Use of Data - Candidates
The Company will process your personal data and/or sensitive personal data with the following recipients:

Those who are responsible for running our business processes including services who support our application management processes

Computerised database provider in order to facilitate the provision of our recruitment services. Our emails, database and data is stored in the cloud. Whilst cloud providers would not typically have direct access to your information, storage is considered processing under the relevant data protection legislation. Your data is stored within the UK and safeguards and security are in place for your protection.

Client/s of the Company in order to provide work-finding services - we will only forward your personal information to clients when you have expressly given your consent for us to do so.

If we are under a duty to disclose or share your personal data in order to comply with legal obligations, or in order to enforce or apply our terms of use, and/or for the purpose of fraud protection.
Fleetwood Saunders takes every precaution and appropriate security measures to protect our candidates information and prevent the loss, unauthorised use, access, alteration or disclosure of your personal data. However, we are not able to guarantee the security of information provided via the internet and by use of email either to or from us.
1.4. Data retention – Candidates
The Company will ensure that your personal data is processed fairly, kept safe and secure and retained for no longer than is necessary.
The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.
Fleetwood Saunders will hold your details for up to 6 years for the purposes of providing ongoing work-seeking services and maintain ongoing professional relationships unless we receive a request from you to remove your personal data sooner.
1.5 Removal of Personal Data - Candidates
As an individual you have a number of rights under the relevant data protection laws, including:

The right to request from us access to your own personal information;

The right to request any inaccurate information we hold about you is corrected;

The right to request the erasure of your personal data in certain circumstances;

The right to request that we limit or stop using your personal information for certain purposes;

You may decide you do not wish your personal information to be collected or shared, or may set conditions on our use of it. In such cases we may not be able to provide the service you require, or may only be able to provide it in a limited way.

This will mean you will no longer be informed of market trends or job opportunities and all personal details will be removed from our database. Requests will be processed within 30 days unless there is a legal requirement for the company to hold certain data, which will be communicated to you at that time.
2. Collection, use and retention of personal data – Clients
2.1 Purpose of collection and processing - Clients
The Company collect very limited personal data on clients, we simply collect enough to ensure that our relationship runs smoothly. This is usually limited to generic details of individual contacts at your organisation comprising of names, telephone numbers and email addresses to enable us to service your recruitment requirements.
We also may hold notes and emails in relation to the recruitment process in particular with tracking and managing submissions of candidates through the recruitment process. We may also hold extra information that someone in your organisation has volunteered to us. In certain circumstances, extra data may be collected in relation with our Finance and Debt Recovery teams.
2.2 Data retention – Clients
The Company has long term relationships with clients, therefore will store “Business” data for the purposes of providing ongoing recruitment services.
The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep information regarding specific hirers we introduce or supply work-seekers to for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with recruitment services.
2.3 Removal of Personal Data - Clients
Individual data for client contacts can be deleted at request, however associated notes and documents will be treated as “Business” data.
